Texas Legal Standards for Modifying a Family Court Order

Under Texas Family Code Chapter 156, most modifications require showing a “material and substantial change in circumstances” since the original order was entered. As a general matter, that means the change must be significant and lasting, not minor or temporary. Common qualifying changes include a major shift in either parent’s income, a relocation, a child’s evolving needs due to age or a newly diagnosed condition, or a significant change in a parent’s living situation.

Conservatorship, Possession, and the One-Year Rule

For conservatorship and possession changes, the court must also find that the modification serves the best interests of the child under Texas Family Code Section 153.002. Texas Family Code Section 156.102 generally bars filing to change the primary residence designation within one year of the current order. To proceed within that window, the filing party must submit a sworn affidavit establishing at least one of three narrow grounds: the child’s present environment may endanger their physical health or significantly impair their emotional development; the person with the exclusive right to designate primary residence is seeking or consenting to the modification; or that person has voluntarily relinquished primary care and possession of the child for at least six months. A child age 12 or older may also express a preference about their primary residence to the judge in chambers, which the judge will consider but isn’t required to follow.

Child Support and Jurisdictional Timeline

Child support operates on a separate track. As general information, a support order may be modifiable without proving a material change if at least three years have passed since the last order and the newly calculated amount would differ from the current amount by 20% or $100 per month. Texas courts retain jurisdiction to modify orders involving children until the child turns 18 or graduates from high school, whichever comes later. The facts of your specific situation will determine which standard applies, and this overview is general information rather than legal advice.

The Modification Process in Victoria County

A modification begins with filing a Petition to Modify the Parent-Child Relationship under the same cause number as the original case. If the child has since moved to a different county, the case may need to be transferred to the county where the child now lives. After filing, the other party must be formally served with the court papers.

Uncontested vs. Contested Modifications

From there, the path depends on whether the parties can agree. An uncontested modification, where both sides reach agreement on all changes, can be finalized relatively quickly once the judge signs the new order. A contested modification moves through temporary orders, discovery, and potentially a final hearing or trial. Many Texas courts encourage or require mediation before a contested hearing. Resolving the matter in mediation can save time and reduce costs compared to going to trial, though outcomes depend on the circumstances of each case.
